FLORIDA — A former Killian High School student has decided not to appeal a March ruling by the U.S. Court of Appeals for the Eleventh Circuit that upheld the suburban Miami district’s right to have her arrested and strip-searched for distributing an underground pamphlet at school.
\n\n Liliana Cuesta and eight other students were arrested in February 1998 at the request of the Miami-Dade County School District for publishing what were perceived as threats in their anonymous underground publication, First Amendment. The 20-page pamphlet included a graphic drawing of Killian’s principal with a dart through his head and musings about the consequences of shooting him.
\n\n In accordance with a Dade County ”zero-tolerance” corrections policy, Cuesta was arrested and strip-searched. She was charged with hate crimes for distributing the pamphlet, but the charges were later dropped.
