UC-Santa Barbara Open Records Trial Delayed

CALIFORNIA — A trial date set for a suit against the Board of Regents of the University of California and Gov. Pete Wilson has been pushed back several months in order to allow time to hear testimony from the regents.

The suit, brought by the student newspaper at UC Santa Barbara, The Daily Nexus, was originally set to go to trial June 30, but will be moved to late November or early December according Dan Tokaji, Southern California ACLU staff attorney, and attorney for The Daily Nexus.

The suit was brought by the newspaper, which claims Gov. Wilson and at least a quorum of the board of regents had secret phone conversations regarding how they would vote on an anti-affirmative action resolution prior to the actual public vote in July of 1995, and in violation of the state’s Open Meetings Act.

A motion for summary judgment filed by the board of regents was denied by the court, and a motion to compel testimony from the regents filed by The Daily Nexus was granted.

Tokaji said depositions have been scheduled for the month of June.

“The regents are finally going to have to tell the truth under oath,” he said.
