MICHIGAN — A federal appeals court upheld the dismissal of charges against a former University of Michigan student who had sent “erotic fiction” over the Internet about a fellow student. Abraham Jacob Alkhabaz, who uses the name Jake Baker, wrote stories that described the torture, mutilation and murder of a female classmate.Baker was suspended from the University and arrested by FBI agents in February 1995 after posting the messages on the Internet Usenet group, “alt.sex.stories.”Baker also exchanged electronic mail with a friend in Canada in which the two discussed carrying out an attack like the one in his story. Prosecutors charged Baker with transporting threatening material across state lines.
