JUDGE ORDERS KY. UNIVERSITY FOUNDATION TO RELEASE CORPORATE DONOR RECORDS

(12/09/04 12:00am)

KENTUCKY — The University of Louisville Foundation has been ordered by a state circuit court to release the names of all corporate and foundation donors, putting to rest unanswered questions from a previous ruling that declared the foundation a public agency that is subject to state open-record laws.

FOUNDATIONS PUSHED TO OPEN

(09/01/05 12:00am)

It’s a question both sides think they know the answer to and one both sides hope the state’s supreme court will take up soon: Are the names of individual donors to public university foundations public under the state open records law?

COURT RULING SUBJECTS KY. UNIVERSITY FOUNDATIONS TO STATE SUNSHINE LAWS

(05/01/04 12:00am)

The state’s highest court has decided not to hear an

appeal by the University of Louisville Foundation of two lower court rulings

that found the private foundation must abide by the state’s freedom of

information laws.By refusing to hear the case on May 12, the Kentucky

Supreme Court resolved a three-year-long legal battle over whether the state

Open Records and Open Meetings Act applies to the private fund-raising arm of

the public university. The foundation, which receives and invests

millions of dollars in donations to the university, has argued that privacy

concerns protect university investments and allows the foundation to shield

donors’ identities. But the Louisville Courier-Journal, which

filed the lawsuit, has argued that because the foundation is so closely tied to

the university, the public has a right to know how the foundation uses its

money, who donates money and what conditions donors place on their

gifts.”The big deal and the monumental victory is the declaration by the

courts of the commonwealth that the University of Louisville Foundation is a

public agency and all of its records are accessible to the public unless they

fall within one of the narrow exemptions of the open-records act,” Kenyon Meyer,

a lawyer for the Courier-Journal, told the newspaper. Two issues

 are left unresolved.

NAMES OF INDIVIDUAL DONORS TO KY. UNIV. FOUNDATION NOT PUBLIC, COURT RULES

(06/03/05 12:00am)

KENTUCKY — The names of more than 45,000 donors to the University of Louisville Foundation will be kept from the public as a result of a recent state appeals court ruling.

The May 20 ruling ensures the anonymity of individual donors to the university’s fundraising arm and overturns a previous ruling by the Jefferson County Circuit Court that said all donors would be subject to public disclosure except those specifically requesting anonymity.

The decision, a victory for the foundation, came as a disappointment to the Courier-Journal, the Louisville newspaper that began battling with the university over the identities of its donors in May 2001.

The newspaper successfully argued in 2002 that the foundation’s ties to the university made it a public institution.
